okay while inputting the specs I put in wrong video card info,
it is a Sapphire 1GB Radeon HD 5770 video card,
Was running with two but took one out to see if that would help but it did not.

This game has had a memory leak forever, and it's never been fixed. It's the only game I've played where I need to relog after a few hours.

I don't see the operating system you have.
I run an old P4 3.2 Ghz (Dual core) with ATI Radeon HD 3850 AGP card.. yes AGP.
I have 4 GB of ram, and I am using the drivers that came with my card, not the most recent update.
I have yet to see 1 message saying out of memory. I am running XP Pro 64 bit OS.
Just saying...
