If you get paid less than $455 per week you can not be considered salaried and should get paid overtime. even if your employer considers you in one of these exempted groups : movie theater employees, live-in domestic employees, farmworkers on small farms, railroad employees (you're covered by the Railway Labor Act) and truck drivers. This is all according to the Fair Labor Standards Act.

ive put this to the test in illinois.
you can be considered salary and only gross $350/wk, while doing all od the standard grunt work and working nearly 60hr.

no. i submitted a report to the illinois labor department
they investigated
they did not have a problem with me being paid $350/wk for 55hrs work

nah
they investigated and found the company to be in violation of lunch break laws.
i got a check for a couple grand.
the other guys who worked there got smaller checks
