I'm not really sure why he thinks it matters. Bitter partisan opposition shouldn't make it ok for the Court to call something unconstitutional. And when the Court is needed most is when the act that passes 95-0 is unconstitutional.

He's a politician now, not a con law professor. I'm sure he was a good con law professor when he was a con law professor. People don't want him to talk to them like a con law professor does.
