Federal judges in California suspended the deportation of seven illegal immigrants in five different cases, telling the prosecution to find out if the illegal immigrants might qualify to stay in the country based on President Obama’s new policy of deprioritizing some deportation cases in favor of others.

“I was surprised. I had not seen an order like that before,” said Bernadette Connolly, an attorney representing one of the illegal immigrants in the Ninth Circuit Court of Appeals, according to Reuters. “She did not request the order and had not even asked the government to review Aranda Rodriguez’s case under the government’s new policy,” Reuters noted.

Last year, Obama’s director of Immigration and Customs Enforcement, John Morton, unveiled a policy of deprioritizing deportations in cases involving illegal immigrants who have no criminal record, other than their illegal immigration. “Monday’s five cases all involved individuals or couples who have been ordered deported but appear to fit Morton’s criteria for leniency,” according to the San Francisco Chronicle.

I'm surprised you would go here, considering he has hired more border agents and deported more illegals (at a faster rate) than Bush or any other Republican.

The number of deportations in 2009 and 2010 is higher under the Obama administration than at any other time, but it's not because of increased enforcement. The higher numbers reflect many removal cases that were already in the pipeline, leftovers from Bush-era enforcement. Once those removals are complete, one wonders how the deportation numbers can possibly be sustained since few new removal cases are being initiated because large numbers of non-criminal illegal alien cases are being dismissed by executive fiat. Deportations have, in fact, already declined slightly from 2009 to 2010.

And there is some differentiation between enforcement (working the borders, stopping people, etc.... bascially the force arm of policy) and the prosecution side of it. These weird hang up for a few people isnt a reflection on the job that agents do in the field, for example. This is definitely a weird twist but I don't know enough about these priority lists to really make a call on it.

The left always gets up in a great mock outrage about judicial political activism. Here you have about the clearest case your going to get of such, and...... *crickets*.

The only time you see the left talk about judicial political activism is when they mock the right for being gigantic hypocrites on the issue.
